Terms of Use

1. Subject of these terms

These terms govern the use of the Oglasna deska mobile application for Android (the "app"). The app is the companion application for the www.oglasna-deska.si website and lets you browse, search and publish classified listings.

By installing or using the app you confirm that you have read, understood and accepted these terms. If you do not agree with them, please do not use the app.

In addition to these terms, our Privacy Policy and the terms of the oglasna-deska.si website apply. Downloading the app from Google Play is also subject to Google's terms; Google is not a party to these terms and is not responsible for the app or its content.

3. Eligibility

• The app may be used by persons over 16 years of age. Minors may use it only with the consent of a parent or guardian.
• Browsing and searching listings is possible without a user account.
• A user account is required for posting listings, favourites and messaging.
• You are responsible for your internet access and any data charges.
• The app is free of charge for users. If we introduce paid services in the future (for example promoted listings), prices and conditions will be stated clearly before purchase.

4. User account

• Provide true and complete details when registering and keep them up to date.
• Your password is confidential; you are responsible for all activity carried out through your account.
• Notify us immediately at info@mibesis.com if you suspect your account has been compromised.
• As a rule one user has one account. Creating accounts with false information or impersonating another person is not allowed.
• You can delete your account at any time – see the account deletion instructions.

5. Rules for publishing listings

• A listing must be truthful, understandable and placed in the appropriate category.
• The price must be stated clearly; if you sell as a company or sole trader you must say so and comply with consumer protection rules.
• Photos must show the actual item being advertised. You may only use material you hold the rights to.
• Do not publish the same listing repeatedly and do not publish listings that are in fact advertisements for another website.
• By publishing content you grant us a non-exclusive, royalty-free and territorially unlimited right to display, store and reproduce that content to the extent necessary to operate and promote the service. Your copyright and ownership rights remain yours.
• Listing content is publicly accessible. Do not publish information you do not want disclosed.

6. Prohibited content and conduct

In particular, it is prohibited to publish or carry out:

• content that is unlawful, offensive, violent, hateful, discriminatory or pornographic;
• listings for prohibited or restricted goods (drugs, weapons and ammunition without a licence, counterfeit goods, protected animal species, prescription drugs and medicines, tobacco products where not permitted);
• fraudulent offers, chain letters, pyramid schemes and "quick money" schemes;
• unsolicited advertising (spam) and mass sending of identical messages;
• publishing other people's personal data without their consent;
• infringement of copyright, trademarks or other third-party rights;
• hacking attempts, circumventing security mechanisms, automated content harvesting (bots and scrapers) and reverse engineering the app, except to the extent permitted by mandatory law;
• conduct that places a disproportionate load on our infrastructure or disrupts the service.

We may remove listings that breach these rules without prior notice and may temporarily suspend or permanently close the user account. We will inform you of the measure by e-mail unless prevented by law or an order of a competent authority. You may object to a measure at info@mibesis.com.

7. Our role and responsibility

• We act as a hosting service provider: we publish listings submitted by users and are not a party to transactions between them.
• The advertiser alone is responsible for the truthfulness, lawfulness and quality of the goods or services advertised.
• We do not systematically pre-screen content, but we remove it as soon as we become aware of its illegality, in line with the Slovenian Electronic Commerce Market Act and the Digital Services Act (Regulation (EU) 2022/2065).
• You can report problematic content to info@mibesis.com, stating the link to the listing and describing the violation.

8. Intellectual property rights

The app, its source code, design, the "Oglasna deska" logo and all other components are owned by MIBESIS d.o.o. or its licensors and are protected by copyright and industrial property law.

We grant you a personal, non-transferable, non-exclusive and revocable right to use the app on devices you control, solely for the purposes described in these terms. You may not copy, modify, distribute, sell, rent out or create derivative works from the app or parts of it.

9. Availability and changes to the service

• We aim for uninterrupted operation but cannot guarantee continuous availability.
• Service may be temporarily interrupted for maintenance, upgrades, faults or circumstances beyond our control.
• We may change, add or discontinue app features. We will inform you of material changes.
• An update to a newer version may be required for the app to keep working. Older versions may cease to be supported after a period of time.

10. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect damage, lost profit, loss of data or damage caused by the conduct of other users, the inability to use the app, or reliance on the content of listings.

Our liability is not limited in cases of intent or gross negligence, for personal injury and death, or in other cases where limiting liability is not permitted by mandatory law. Statutory consumer rights are not affected.

11. Consumer rights

The app is offered free of charge, so no payment obligation arises. If we offer paid digital content or services in the future, we will inform you of the price, payment method and right of withdrawal before purchase, in accordance with the Slovenian Consumer Protection Act (ZVPot-1).

Complaints are handled at info@mibesis.com. We do not recognise any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute under the Slovenian Out-of-Court Settlement of Consumer Disputes Act.

12. Duration and termination

• The contractual relationship lasts as long as you use the app or hold a user account.
• You may uninstall the app and delete your account at any time. Uninstalling the app alone does not delete the account.
• We may terminate the relationship in the event of serious or repeated breaches of these terms.
• The provisions on intellectual property, limitation of liability and governing law survive termination.

13. Changes to these terms

We may amend these terms as the app develops, when legislation changes, or for business reasons. Amended terms are published on this page together with the effective date. We will notify you of material changes in the app or by e-mail at least 15 days before they take effect. If you do not agree with the changes, stop using the app and delete your account.

14. Governing law and dispute resolution

These terms are governed by the law of the Republic of Slovenia, excluding its conflict-of-law rules. Disputes that cannot be settled amicably fall within the jurisdiction of the competent court in Maribor, Slovenia. If you are a consumer, this does not affect your right to bring proceedings before a court in your country of residence, nor does it deprive you of the protection of that country's mandatory rules.

If any provision of these terms is invalid, the validity of the remaining provisions is not affected.
